Authorized Representative

The Department of Labor provides that a claimant may have someone assist them with their claim. That individual is called an Authorized Representative. There can only be one Authorized Representative for an EEOICP claim. The Authorized Representative may advocate on behalf of the claimant with the Department of Labor and the National Institute for Occupational Safety and Health. The Authorized Representative does not have to be an attorney. The Energy Employee Occupational Illness Program limits the amount of compensation an Authorized Representative may receive for assisting a claimant. 


Unless the claimant’s authorization specifies otherwise, a properly appointed authorized representative has the authority, to the same extent as the claimant, to present or seek evidence, make factual or legal arguments, and obtain information from the case file. 20 C.F.R. §§ 30.600; 30.601.
